I was looking at a dog breeder's ad for a pure breed pup they were trying to sell (hey, I was just looking! I am not getting another pup! ) and the breeder is insisting the purchaser of the dog agree to a no breeding clause whereby the owner will have the dog sterilized and not use the dog to breed.

I sezs to Mr...'just how can the seller (breeder) insist the buyer adhere to this condition?'

Mr sezs the seller can not enforce this.

I agree.

But why would they insert that clause if they can not legally enforce it?

Perhaps the dog has to be registered as neutered under your ownership, but before he leaves the current owners ?

  I am not sure but great question. I understand that dogs can be neutered at 6 months of age and not before. Bizarre really. xxx

That is a common practice with breeders...it is a different world let me tell you. They want to control the bloodline of the dogs they sell and avoid any abnormalities that may occur like hip dysplasia. I know it sounds condescending but it is actually a good thing it prevents overbreeding and interbreeding. That is what puppy mills do...I just shudder at the thought of puppy mills.
I don't know how binding it is but it is sanctioned by the Canadian Kennel Club.

I'm sure it will be something to do with bloodlines and avoiding interbreeding, seeing as pure-blood lines in the dog world are so strict. But I'm not sure they can legally insist on it.

  I would love a puppy but not crazy about house training it. The legal amount a homeowner can have in Oshawa is three so we are at our limit. A new kitty would be nice....

  Several times when we bought dogs we had to agree to having them neutered, I did not have a problem, but then again we did not show them or want to breed. When you want to breed your dog the price goes up to an unbelievable price, My daughter paid $4000 dollars for her dog, and then had to have it put down because of over agression, but he died with his Championship go figure aye.

That sounds creepy to me. Best ask the people who wrote that contract and then tell us what they say.

I got my cats from the rescue. Their Mum was thrown out when the owners found out she was pregnant, so she was in the rescue centre till she had her kittens. I took two of them, and the contract I signed when I got them included having them sterilised. When they got to the age to be sterilised, they phoned me to check I had done it, and continued to threaten to take the cats back if I didn't get it done. I then had to produce a certificate from the vet when it was done.

  Wow. Your story reminds me of my Anna and when we got her from a rescue as well. She was 18 months old and we were given a month to produce a certificate that showed she was sterilized.

    TBH I think it is a good idea. I don't think folk should be breeding animals without a licence and proper controls. There are too many unloved and stray animals in the world for folk to be adding more, willy-nilly. I don't know if it is binding in Canada, though.

      I think it is an excellent idea and I couldn`t cope with breeding animals. It is the responsible thing to do to get your animals neutered. xx

If you signed a contract to do it as part of getting the puppy then its the contract that is legally binding.

The boyfriend's sister got a dog and the breeder had a standard contract that all prospective owners had to sign. Thay couldn't not smack it or yell at it, it had to be trained, not be fierce or it'd be taken away by the breeder with no compensation.

    Just take you to court. It'd be treated just like any other breach of contract.
    
    What gets me is that I can see the whole bloodlines and disease thing. But how many are out there doing these contracts to prevent other people becoming competition.
    Its from the same lineage, same good bloodlines. Be just as desirable if its from good stock.
